In Hughes [2019] TC 07417, the First-tier Tribunal (FTT) allowed an appeal by an individual against HMRC’s finding that she had received an unauthorised member payment from her pension scheme in respect of a loan on the basis that there was insufficient evidence showing a connection between the loan and her investment in the pension scheme fund.


Miss Hughes (the appellant) received a £10,000 loan from Blu Funding Corporation Limited (‘Blu’) in October 2012. Separately, she transferred pension funds of £31,000 from Scottish Life into Fast Pensions’ (‘Fast’) FP1 Retirement Plan.
