There are two notions of permanent establishment embodied in art. 5 of the OECD Model:

(1)physical permanent establishment: this is a fixed place of business through which the business of the enterprise is wholly or partly carried on; and

(2)agency permanent establishment: this applies to dependent agents exercising their authority to contract.
