Whereas SA 1891, s. 5 requires all the facts and circumstances affecting the liability of any instrument chargeable to stamp duty to be ‘fully and truly set forth’ on the face of the instrument, it can be that the consideration for a transfer on sale is made contingent on the happening of some event or, say, on a percentage of the purchaser’s profits at some future date.
