There is limited authority relating to applications under AJA 1985, s. 50 but it is clear that parallels can and should be drawn with the jurisdiction to remove trustees25.

The court has inherent jurisdiction to remove a trustee and a statutory jurisdiction under Trustee Act 1925, s. 41.26 That is a wide power of general application27 and a trustee can be removed or an appointment made against his or her will if the court is satisfied that it is expedient to make such an appointment, even if the claim is not made.28
