51-200 ‘Variations’ under the Trustee Act 1925, section 57
This provision enables the trustees to ask the court to insert administrative powers. It does not allow the court to make orders to alter beneficial interests. The court will exercise the power where a transaction cannot be effected which the court considers expedient for want of an appropriate administrative provisions. The power may be conferred generally or in respect of a particular transaction42a. Applications may be made by trustees or any person beneficially entitled.43 The consent of an adult beneficiary is not required. The court will act if it considers that the transaction would be in the interests of the beneficial class as a whole44.
