When it is open to doubt whether or not a claim against an estate is valid, the personal representatives must either at their discretion compromise or agree the position with the claimant,21 or submit the question to the court for determination.22

Worked example

After the deceased’s death, the personal representatives discover the following debts owed, or alleged to be owed, by the deceased:

(i)A debt owed to a builder who carried out work to the deceased’s home over six years ago.

(ii)A debt for work done by solicitors in selling the home and purchasing a new one.
