There is no legal property in a dead human body, but in all ordinary circumstances, where there is no suspicion of crime, the executor has a right to possession of the body for disposal.10 The personal representative has the right to the custody and possession of the body until it is ‘properly buried’. Where there is a dispute, the person in lawful possession of the body may make appropriate arrangements for disposal but an application for directions may be necessary.11
