Under CAA 2001, s. 176, a person is treated as owning a fixture as a result of expenditure he has incurred if the following conditions are met:

he incurs capital expenditure on plant or machinery;

the asset is for the purposes of a qualifying activity that he is carrying on;

the plant or machinery in question becomes a fixture; and

the person incurring the expenditure has an interest in the relevant land at the date on which the asset becomes a fixture.
