The election described below may only be made in respect of a lease that provides for ‘staircasing’, which is a term used but not defined in the legislation.

The lease must satisfy the following conditions:

the lease is of a dwelling;

it gives the tenant exclusive use of the dwelling;

it provides for the tenant, on payment of a sum, to require that the lease be varied so that the rent payable under it may be reduced;
