7.3.1 JGE v Portsmouth Roman Catholic Diocesan Trust

This was a vicarious liability case concerning one Fr Baldwin, a Catholic priest alleged to have abused a girl in a childrenʼs home; the question arising being whether the Diocese of Portsmouth was liable for his actions as his employer. MacDuff J in the High Court considered it uncontroversial that:

‘a bishop and priest would not regard their relationship as being one that could be adjudicated upon by the civil courts; and Father Baldwin would have been considered as a holder of office rather than an employee of the Defendants’.
