3.6.1 House of Lords

The leading House of Lords case is Carmichael v National Power, whose main decision was to uphold Ready Mixed Concrete. It concerned two guides at a power station who were offered ‘employment on a casual as required basis’. They claimed unfair dismissal when told that they were no longer wanted: something that required continuous employment for at least a year. Note that this case did not decide whether there might have been a series of employment contracts beginning each time that they started work and ending when they finished – as Lord Irvine of Lairg put it:
