Under a practice direction issued by the Senior President of Tribunals on 12 March 2009, the following guidance determines who should make decisions in particular cases:

If a decision has been given that disposes of proceedings, the following further decisions should generally be made by a single Judge:

any further decision that suspends the effect of the earlier decision pending an application for permission to appeal, a review application or an appeal itself (see rule 5(3)(l)); and

any decision upon a review of the decision (see 9.3.4ff. above).
