Historically, it was rare for HMRC to seek to argue that a loss of tax was brought about deliberately (or, to use the pre-2010 wording, fraudulently). This was because the time limits that governed discovery assessments and the old penalty rules did not expressly differentiate between different types of culpable conduct.
