4.5.1 The statutory definition

Although Tribunals often try to apply the normal meaning of the term (as was necessary under the previous equivalent test for negligence), there is in fact a statutory definition of careless conduct. It provides as follows:

‘a loss of tax or a situation is brought about carelessly by a person if the person fails to take reasonable care to avoid bringing about that loss or situation.’
