Control.

  Whether an engineer working for a local authority was engaged under a contract of service or a contract for services: contract of service.

  Control not the decisive test when dealing with a professional person or someone with particular skill and experience. In such cases, an employer will not tell the worker how to do the work, so the absence of control and direction is of little use (if any).
