3.5.1 The common law position

The common-law rules on the tax-treatment of share options are set out in the House of Lords decision in Abbott v Philbin. In that case it was decided that options granted to an employee were a perquisite of his employment and that the employee should be taxed on the market value of the options on the date that the options were granted.
