Where a taxpayer has failed to submit an EU sales list by the due date, HMRC can issue a notice of default (VATA 1994, s. 66). Such a notice applies for at least 12 months, commencing on the day following its service. Further defaults during the default period result in its extension until at least 12 months have elapsed without the taxpayer becoming liable to a penalty.
