In National Water Council v C & E Commrs (1978) 1 BVC 199, the court held that the word ‘business’ was not restricted to activities which were carried on commercially and the mere fact that services were supplied in the performance of a statutory duty did not of itself stop them from being supplied ‘in the course of a business’. Neill J said that it would not be right for him to make findings in respect of each of the individual activities carried on by the Council and said at p. 208:
