A debt may be satisfied, wholly or in part, by the transfer of property. If so, then the creditor’s acquisition of the property and the debtor’s disposal of it are treated for capital gains purposes as being for no more than the market value of the asset at the time of the creditor’s acquisition (TCGA 1992, s. 251(3)).
