The disposition of an estate may be altered by the beneficiaries and it may be in their interests to do so (see ¶367-800). In order that a variation or disclaimer does not constitute a disposal for capital gains tax purposes it must satisfy the conditions set out below (TCGA 1992, s. 62(6)(8); for the detailed effect, see ¶367-850).
