Settlement income which is given by UK-resident trustees to a charity in the tax year in which it arises, or which is income to which a charity is entitled under the terms of the trust, is not to be taxed on the settlor under either head of charge. To qualify for this exception the charitable payment must be out of ‘qualifying income’, which is defined as:

income which the trustees are obliged to accumulate;
