Where property is held on trusts for a relevant minor, those trusts will be qualifying trusts if either:

the parent of the minor dies without making a will and the statutory intestacy rules provide for the property in question to be held on trusts for the benefit of the child, under the Administration of Estates Act 1925, s. 46, 47(1);

the parent of the minor dies and establishes a will trust meeting certain conditions; or

a trust (meeting certain conditions) is established under the Criminal Injuries Compensation Scheme (CICS) or the Victims of Overseas Terrorism Compensation Scheme

(FA 2005, s. 35(1), (2)).
