The social enterprise must not at any time in the shorter applicable period (see ¶322-125) be controlled by another company, or by another company and any person connected with it; and there must be no arrangements in place for it to be controlled by another company (ITA 2007, s. 257ME(2),(3)).

The social enterprise may have subsidiaries, but if it does they must all be subsidiaries in which the company has more than 50% of the ordinary share capital and which are not controlled (by other means) by any other company (a ‘qualifying subsidiary’)( ITA 2007, s. 257MF).
