Where the activities of the previous businesses are similar in nature, the activities of the merged business may have the same essential characteristics of both previous businesses. The new business must be capable of being described as a single business otherwise no merger has taken place and the existing businesses are simply continuing under common ownership. The new business may be an enlarged version of one or other of the previous businesses in which case, the new business will have succeeded to either or both previous businesses.
