The Treasury have power to make regulations to ensure that civil partnerships and the members of such partnerships are treated as, or in the same way to, marriages and married persons (FA 2005, s. 103(1)). The Treasury also have power to make regulations to remove inequality of treatment based upon gender, or in the case of a parent, by marital status (FA 2005, s. 103(3)).

These powers are to be exercised by statutory instrument, which is to be subject to the affirmative procedure by the House of Commons (FA 2005, s. 103(5)).
