The term ‘yearly interest’ is not defined within the legislation. Indeed, neither is the simple term ‘interest’. The latter term has, however, been subject to a number of judicial pronouncements and a full discussion of these may be found at ¶327-050. In simple terms, it may be said that interest, by whatever other name it may be called, is the price paid for the use of money by a borrower.
