The concept of ‘habitual residence’ was introduced into NIC law by the English translation of the former EC Regulations on social security for migrant workers. Although the UK finally left the EU at the end of the transition period on 31 December 2020, the term remains in UK social security law and in the EU-UK Trade and cooperation agreement and therefore remains relevant.
