In Groupe Steria SCA v Ministere des Finances et des Comptes publics (Case C-386/14) [2015] BTC 34, the ECJ held that French group tax rules that were discriminatory as between dividends received from French resident subsidiaries and from subsidiaries resident in other member states, offended the French parent company’s freedom of establishment.
